This “Privacy Policy” regulates how your personal data is processed by horsum CVBA, a company registered in Belgium, with registered office in B-9830 Sint-Martens-Latem, Kortrijksesteenweg 48 Bus 2, registered in the register of legal entities under company number 0839.254.589.

 

Please read this “Privacy Policy” carefully as it contains essential information about how your personal data is processed, and which cookies are used. By using our services or providing your services, signing an agreement with us, or visiting our website (accessible via the following web address: www.horsum.be), you declare that you have read this Privacy Policy, and that you expressly consent to its content, as well as to the processing itself.

Article 1 - General

Through the present Privacy Policy, horsum is in compliance with the European Regulation 2016/679 of April 27, 2016 on the protection of personal data, as well as with the transposition of this European Regulation into Belgian law, which came into force on September 5, 2018 and which repeals the Belgian Privacy Law of 1992.

Also, horsum respects the anti-spam provisions of Book XII of the Belgian Code of Economic Law, relating to the “Law on Electronic Economy”.

Article 2 - To whom does this privacy statement apply, and what is covered by the statement

We are committed to protecting your privacy, and to handling your information in an open and transparent manner.

This privacy statement describes how we will collect, handle, store and protect information about you when:

  • we provide services to you or our customers;
  • you use “our website”;
  • we conduct other activities that are part of our business, as described in more detail below.

When we refer to “our website” or “this website” in this statement, we mean the specific website that starts with “horsum.be”.

This privacy statement also contains information about when we share your personal information with third parties (such as our service providers).

We may also label the use, collection, protection and maintenance of your personal data as “processing” such personal data.

The personal data we collect or obtain may include the following: your name, age, date of birth, gender, email address, phone number, address, country of residence, employment data (such as the company you work for, your job title) and education data, your posts on blogs, forums and any other social media applications and services we provide, your IP address, your browser type and language, when and how long you visit our website, complaint data, data about how you use our products and services, data about how you like to communicate with us, and other similar information.

The personal data we collect may also include so-called “sensitive” or “special categories” of personal data, such as data about your dietary requirements (for example, if horsum would like to provide lunch during a meeting).

  • The types of personal data and special categories of personal data we collect may vary depending on the nature of the services we provide to you, or our client, or on your use of the website. In exceptional circumstances, we may also collect other special categories of personal data about you because you voluntarily provide that data, or because we are required by law to collect that data.
  • We understand the importance of protecting children's privacy. Our website and services are not designed for, or intentionally targeted at, children. It is not our policy to knowingly collect or store data and information about children.

 

Article 4 - How do we process your personal data? 

Using personal data to provide services to our clients.

We will use your personal data to provide you or our client with requested services. As part of this, we might also use your personal data during correspondence related to these services. Such correspondence may occur with you, our client, our service providers, or appropriate authorities. We may also use your personal data to conduct “due diligence” analyses related to our services. Because we offer different types of services to our clients, how we use personal data varies with our types of services.

Using personal data for activities other than those that are part of our business operations

  • applicable legal obligations;
  • requests and communications from competent authorities;
  • administrative purposes;
  • accounting, billing and risk analysis;

The use of personal data collected through our website

In addition to the purposes above, related to our business operations, we may also use your personal data collected through our website to:

  • tailor the content of our Web site to provide you with a more personalized experience;

A “cookie” is a small text file sent by the horsum server and stored on your computer. The information stored on these cookies can only be read by us, and only for the duration of your visit to our website.

Our website uses cookies and similar technologies to distinguish your user preferences from those of other visitors to our website. This helps us to provide you with a better user experience when you visit our website, and to optimize our website.

Artikel 5 - Legal grounds on which we rely for processing your personal data

We use your personal data for the purposes described above because: (a) we are subject to legal obligations; (b) the information is required in order to provide our services to you or our client; (c) we have legitimate interests in effectively providing our services to you or our client.

To the extent that we process sensitive personal data about you for any of the purposes described above, we will do so because either: (i) you have given us your explicit consent to process the data; (ii) we are required by law to process the data to ensure that we meet our “know your customer” obligations (or other legal obligations); (iii) the processing is necessary to fulfill our obligations under labor, social security or social protection laws; (iv) the processing is necessary for the establishment, exercise or defense of legal claims or (v) you have made the data publicly available.

Where we are required by law to obtain your express consent to send you certain marketing materials, we will only send you these marketing materials where we have obtained such express consent from you.

If you no longer wish to receive marketing materials from us, you may click the “unsubscribe” button in any such communication.

 

Article 6 - To whom do we make your data available?

With respect to one or more purposes described in the “How do we use information about you?” section above, we may potentially disclose information about you to: third parties providing services to us; authorized entities (including courts and authorities; your employer and/or their advisors; your consultants; organizations that help us reduce fraud risk, and other third parties who need access to personal data for one or more purposes described above in the “How do we use information about you?” section).

Our website features blogs and other social media applications or services that allow you to share content with other users (collectively referred to as “Social Media Applications”). Important: Any of the personal information you contribute to these Social Media Applications may be read, collected, and used by other users of the application. We have little to no control over these other users, and we therefore cannot guarantee that information you share through these Social Media Applications will be treated in accordance with this Privacy Statement.

Please note that some recipients of your personal data, as indicated above, could be based in countries outside the European Union, where the legislation may not provide the same level of data protection. In such cases, we will ensure that appropriate protection is provided to protect your personal data so that these recipients comply with our legal obligations. The appropriate protection for third parties would be a “data sharing agreement” with the recipient, based on standard contractual clauses approved by the European Commission, for transfers of personal data to countries outside the EU.

Article 7 - We care about your personal data

We will retain your personal data for the longest of the following periods: (i) as long as necessary for the relevant activities or services; (ii) legally required retention period; or (iii) the end of the period during which proceedings or investigations might arise relating to the services.

We use a range of physical, electronic and managerial measures to ensure that we keep your personal data secure, accurate and up to date. These measures include:

  • Education and training to our relevant employees to ensure they are aware of our privacy obligations when we process personal data;
  • Administrative and technical controls to limit access to personal data;
  • Technological security measures;
  • Physical security measures, such as restricted access to our premises.  

Although we use appropriate security measures once we have received your personal data, the transmission of data over the Internet (including via e-mail) is never completely secure. We strive to protect personal data, but we cannot fully guarantee the security of data transferred to us, or by us, over the Internet.

 

Article 8 - Your rights 

You have several rights regarding your personal data. More specifically, you have the right to:

  • obtain confirmation that we are processing your personal data, and request a copy of the personal data we hold about you;
  • ask us to update your personal data, or to correct personal data that you think is incorrect or incomplete;
  • ask us to delete your personal data, or limit the way we use your personal data;
  • withdraw your consent to the processing of your personal data (provided that the processing is based on consent);
  • object to the processing of your personal data.
